1. Scope of the Terms and Conditions

These General Terms and Conditions (T&Cs) apply to legal transactions between Alps Sky Taxi & Transfer and customers who are consumers.


2. Offers and Conclusion of the Contract

2.1. Our offers are non-binding and subject to change.
2.2. The contract is concluded only upon our written confirmation or the actual execution of the transfer.
2.3. The customer is obligated to inform us of any special requirements or security risks (e.g. bulky luggage, transfer to large events, or similar conditions) during the booking. If this information is not provided and we only become aware of it after the contract has been concluded, we reserve the right to withdraw from the contract.
2.4. If the customer properly informs us of a risky trip and we decide not to carry out the trip after the contract has been concluded, we can withdraw from the contract without entitlement to payment.


3. Contract Content and Service Delivery

3.1. The subject of the contract is the agreed transport service.
3.2. Departure and arrival times are approximate. The actual travel time may vary due to external circumstances.
3.3. The choice of vehicle within the ordered category is at our discretion. The use of a larger vehicle is permitted without increasing the cost to the customer.
3.4. The choice of route is at the driver's discretion, who may deviate from it for safety or traffic reasons.
3.5. Compliance with legal regulations (driving breaks, rest periods) is mandatory. Services that violate these will be refused.
3.6. Rides are only possible within the approved passenger capacity.


4. Payment


4.1. The agreed fee includes the transport service and vehicle-related expenses. Additional costs (e.g. tolls, parking fees) are to be borne by the customer.
4.2. Extra services ordered subsequently will be billed separately.
4.3. Offsetting against our claims is excluded unless legally permitted or acknowledged.
4.4. For individual seat bookings, proportional cost regulations apply.


5. Cancellation

5.1. The customer can cancel the transport.
5.2. Cancellations must be made in writing (via email). For cancellations, Alps Sky Taxi & Transfer charges a portion of the base fare as cancellation fees.

The portion is:

Before the 30th working day: Free of charge
Up to the 30th working day: 10%
From the 29th to the 20th working day: 30%
From the 19th to the 10th working day: 50%
From the 9th to the 4th working day: 70%
From the 3rd working day: 100%


6. Passenger Behavior

6.1. The customer is responsible for the behavior of their fellow passengers.
6.2. Passengers must comply with the provisions of the operating regulations for non-scheduled passenger transport (BO 1994). The driver may refuse transportation in case of violations.
6.3. In the event of exclusion, the right to a refund or return transport is forfeited.
6.4. We are not liable for delays caused by late passengers or missing travel documents.
6.5. Seat belts must be worn during the ride. Seats may only be briefly vacated.
6.6. The use of media playback devices is at the customer's own risk, and the customer holds us harmless in the event of copyright infringements.
6.7. The customer is liable for damages or contamination caused by passengers.


7. Luggage

7.1. Luggage must be securely packed and labeled with the name and address.
7.2. The customer is responsible for loading and unloading the luggage.
7.3. The transport of luggage is subject to available storage space. Dangerous items are excluded.
7.4. Hand luggage must not impair safety or order.
7.5. Assistance animals may be carried; other animals only with the driver's consent.
7.6. We are not liable for items left behind in the vehicle, unless we acted negligently.


8. Written Form and Applicable Law

8.1. Amendments must be made in writing.
8.2. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and international conflict of laws rules.
